ABSICAN is required to conduct checks and certify the absence of sexual offenses on employees and volunteers performing certain functions.

The Ministry of the Presidency, Justice, and Parliamentary Relations has developed a new software application, “TeAutorizo,” which allows entities whose activities involve regular contact with minors—from daycare centers to children’s clothing stores to leisure associations, for example—to expedite the process of obtaining certificates of absence of sexual offenses for their employees.

TeAutorizo ​​reduces the administrative burden on companies and expedites the onboarding of future employees by freeing them from the need to obtain their own certificate of absence of sexual offenses.

With TeAutorizo ​​and the reform of Royal Decree 1110/2015, the Ministry contributes to compliance with Organic Law 8/2021 on the comprehensive protection of children and adolescents against violence.

Aarons Department is an umbrella body that provides access to DBS checks for organizations that cannot register directly with the Disclosure and Barring Service: this is only an option for organizations that process hundreds of DBS checks per year. ABSICAN uses Aarons Department to conduct a Disclosure and Barring Service Check, a criminal record check in the UK used by employers to determine whether an applicant is suitable for a position.

We will also request equivalent certification from other equivalent authorities for other nationalities.

  5. Limitation of purpose: personal data will be collected for specific, explicit and legitimate purposes, and will not be further processed in a manner incompatible with those purposes.
  6. Data minimization: personal data will be adequate, pertinent and limited to what is necessary in relation to the purposes for which they are processed.
  7. Accuracy: personal data will be accurate and, if necessary, updated; All reasonable steps will be taken to ensure that personal data that is inaccurate with respect to the purposes for which it is processed is deleted or rectified without delay.
  8. Limitation of the conservation period: the personal data will be kept in such a way that the identification of the interested parties is allowed for no longer than necessary for the purposes of the processing of the personal data.
  9. Integrity and confidentiality: personal data will be processed in such a way as to guarantee adequate security of personal data, including protection against unauthorized or illegal processing and against accidental loss, destruction or damage, through the application of technical or appropriate organizational
  10. Information and training: one of the keys to guarantee the protection of personal data is the training and information provided to the personnel involved in their processing. Identification and Prevention of Money Laundering

All foundations and associations, whatever their nature and size, are obligated subjects – under a special regime – of the LPBC (Money Laundering Prevention Act). Therefore, we must comply with Law 10/2010, of April 28, and Royal Decree 304/2014, of May 5.

Article 39 of the LPBC establishes the following obligations to be fulfilled by foundations and associations, among other things:

Identify and verify the identity, according to the form provided for in the LPBC and its Regulations, of all persons who receive funds or resources free of charge, as well as all persons who carry funds or resources free of charge for an amount equal to or greater than 100 euros.

Violations for failure to comply with the obligations of the LPBC are divided into minor, serious and very serious. Failure to identify donors and beneficiaries may result in a serious offence and a fine of at least 60,001 euros.
